Welcome to Old Dog shop.
These Terms of Service ("Terms") govern your access to and use of the Old Dog shop website and online store, including all related content, features, products and services (collectively, the "Services").

By accessing or using our Services, you agree to these Terms. If you do not agree with these Terms, please do not use the Services.
These Terms apply subject to any mandatory consumer rights and protections applicable under Romanian and European Union law. Nothing in these Terms limits or excludes rights that cannot legally be limited or excluded.
1. ELIGIBILITY AND USE OF THE STORE
You may use our Services only for lawful purposes and in accordance with these Terms.
By using the Services, you confirm that the information you provide to us is accurate, complete and up to date.
If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for activities carried out through your account.
You must not use our Services for fraudulent, unlawful or abusive purposes.
Our store is intended primarily for consumers. If you are purchasing products for commercial resale, please contact us before placing an order.
2. OUR PRODUCTS
We make reasonable efforts to ensure that product descriptions, photographs, dimensions, materials and other information displayed on our website are accurate.
However, colours and visual appearance may vary depending on your screen, device settings and other technical factors.
Minor variations in appearance, printing, colour or finish that do not affect the essential characteristics or functionality of a product do not constitute a defect.
We reserve the right to modify product descriptions, discontinue products and limit quantities where reasonably necessary.
Nothing in this section affects your statutory rights regarding the conformity of goods.
3. ORDERS AND CONTRACT FORMATION
When you place an order through our store, you submit an offer to purchase the products in your order.
After placing an order, you will receive an acknowledgement confirming that we have received your order. This acknowledgement does not necessarily mean that your order has been accepted.
A sales contract is formed when we accept your order and confirm it to you, normally by email.
We may refuse or cancel an order before acceptance where, for example:

a product is unavailable;

there is an obvious pricing or description error;

we reasonably suspect fraudulent or unlawful activity;

technical problems prevent us from processing the order; or
-
fulfilment of the order is otherwise impossible.
If we cancel an order after payment has been received, we will refund the amount paid using the original payment method, unless otherwise agreed with you.
Nothing in this section affects your statutory consumer rights.
4. PRICES AND PAYMENT
All prices displayed in our store are shown in the currency indicated on the website.
Unless otherwise stated, applicable taxes are included in the displayed consumer price where required by applicable law.
Shipping costs and any additional charges will be displayed before you complete your purchase.
For orders shipped outside the European Union, the customer may be responsible for customs duties, import taxes, brokerage fees or other charges imposed by the destination country.
We accept the payment methods displayed at checkout.
You agree to provide accurate and complete billing and payment information.
We may use third-party payment providers to process payments. We do not store full payment card details where those details are processed directly by the relevant payment provider.
5. SHIPPING AND DELIVERY
We ship orders to the destinations indicated on our website.
Available delivery methods, estimated delivery times and shipping costs will be displayed during checkout.
Delivery times are estimates unless a specific delivery date has been expressly agreed.
We are not responsible for delays caused by events beyond our reasonable control, including carrier delays, customs procedures, natural disasters, strikes or other extraordinary circumstances.
However, delays do not affect your statutory rights.
Where no other delivery period has been agreed, EU consumer law generally requires goods to be delivered without undue delay and, in any event, within 30 days of conclusion of the contract.
If we fail to deliver within the applicable period, you may have rights to require delivery within an additional appropriate period and, where applicable, terminate the contract and receive a refund in accordance with applicable law.
Risk during delivery
For consumer purchases, the risk of loss or damage to the goods generally passes to you when you, or a third party designated by you other than the carrier, physically receive the goods.
If you independently appoint a carrier that was not offered by us, the risk may pass to you when the goods are handed to that carrier, where permitted by applicable law.
6. RIGHT OF WITHDRAWAL — EU CONSUMERS
If you are a consumer located in the European Union, you generally have the legal right to withdraw from a distance purchase within 14 days without giving any reason.
For goods, the withdrawal period begins on the day you, or a third party designated by you other than the carrier, receive the goods.
If an order contains several goods delivered separately, the withdrawal period generally begins when you receive the last good.

You may simply send us a clear statement that you wish to withdraw from the purchase. You do not have to use a specific form, although you may request one from us.
After notifying us of your withdrawal, you must send the goods back without undue delay and no later than 14 days from the day on which you notified us of your withdrawal.
You are responsible for the direct cost of returning the goods unless we have agreed to bear those costs or applicable law provides otherwise.
You are responsible only for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
7. REFUNDS FOLLOWING WITHDRAWAL
If you exercise your statutory right of withdrawal, we will reimburse the payments we received from you, including the cost of standard delivery.
If you selected a more expensive delivery method than the least expensive standard delivery option we offer, we are not required to reimburse the additional cost.
We will make the refund without undue delay and, in any event, within 14 days from the date on which we are informed of your decision to withdraw.
However, where permitted by law, we may withhold the refund until we receive the returned goods or until you provide evidence that you have sent them back, whichever occurs first.
Refunds will normally be made using the same payment method used for the original transaction, unless otherwise agreed with you.
The refund will not incur any additional fee for you.
8. VOLUNTARY 30-DAY RETURN POLICY
In addition to the statutory 14-day right of withdrawal available to EU consumers, Old Dog shop may offer a voluntary 30-day return policy for eligible products.
The conditions of this voluntary return policy are described in our Return & Refund Policy.
This voluntary policy is additional to, and does not replace or restrict, any statutory consumer rights.
Where the statutory 14-day withdrawal period applies, those statutory rights take precedence over any conflicting voluntary return conditions.
9. DEFECTIVE OR NON-CONFORMING GOODS
If a product is defective, damaged, incorrect or does not conform to the contract, please contact us at:

Consumers in the European Union benefit from statutory rights concerning the conformity of goods.
Where a lack of conformity exists, you may be entitled to remedies provided by applicable law, which may include repair, replacement, a price reduction or termination of the contract, depending on the circumstances and applicable legal requirements.
These statutory rights apply independently of our voluntary return policy and cannot be excluded or reduced by these Terms.
10. PRODUCTS THAT CANNOT BE RETURNED
The statutory right of withdrawal does not apply in circumstances where an exception is provided by applicable law.
Depending on the product, this may include:

goods made to the consumer's specifications or clearly personalised goods;

goods that are liable to deteriorate or expire rapidly;

sealed goods which are not suitable for return for reasons of health protection or hygiene where the seal has been removed after delivery; and

other products or services for which the right of withdrawal is legally excluded.
A product being discounted or sold during a promotional period does not, by itself, remove statutory consumer rights.
11. EXCHANGES
We do not generally provide direct exchanges.
If you wish to purchase another product, size or variant, you may return the original product where eligible and place a new order separately.
This does not affect your statutory rights regarding defective or non-conforming goods.
12. INTELLECTUAL PROPERTY
All intellectual property appearing on or forming part of the Services, including trademarks, logos, artwork, illustrations, photographs, graphics, text, product designs, videos, audio, layouts and other content, is owned by or licensed to Story Shelf SRL, Old Dog shop, our artists, authors, licensors or other rights holders.
You may access and use the website for personal, non-commercial purposes.
You may not reproduce, distribute, modify, publicly display, publicly perform, republish, sell, license, create derivative works from or commercially exploit our content without prior written permission from the relevant rights holder.
Nothing in these Terms transfers ownership of intellectual property to you.
All rights not expressly granted are reserved.
13. CUSTOMER REVIEWS AND FEEDBACK
If you voluntarily submit reviews, comments, photographs, suggestions or other content to us ("Feedback"), you remain responsible for the content you submit and must have the necessary rights to submit it.
By submitting Feedback, you grant Story Shelf SRL a non-exclusive, worldwide, royalty-free licence to use, reproduce, display and publish that Feedback in connection with operating and promoting the Services.
We may remove or refuse to publish Feedback that is unlawful, defamatory, abusive, fraudulent, obscene, infringes intellectual property rights, contains malicious software or otherwise violates these Terms or applicable law.
We do not claim ownership of your original Feedback.
14. THIRD-PARTY SERVICES AND LINKS
Our Services may use third-party services, applications, payment providers, shipping providers, analytics services and other tools.
Third-party services may be governed by their own terms and privacy policies.
We are not responsible for the content or operation of third-party websites that we do not control.
However, this does not exclude any liability that cannot legally be excluded.
15. SHOPIFY
Our online store is hosted and powered by Shopify.
Shopify provides the technology infrastructure that allows us to operate our online store. However, purchases made through our store are transactions between you and Story Shelf SRL / Old Dog shop.
Shopify is not the seller of the products offered through Old Dog shop.
Your use of Shopify-powered functionality may also be subject to Shopify's own terms and privacy policies.
16. PRIVACY
Personal data collected through our Services is processed in accordance with our Privacy Policy.
Our Privacy Policy explains what personal information we collect, why we collect it, how we use it, how long we retain it and the rights available to you.
Because our store is operated using Shopify and other service providers, personal data may be processed by those providers where necessary to operate the store, process payments, fulfil orders, provide customer support, prevent fraud or otherwise provide the Services.

17. PROHIBITED USE
You must not use the Services:

Nothing in this section restricts lawful use of the website, including use by search engines or accessibility tools where permitted by law.
18. ERRORS AND CORRECTIONS
We make reasonable efforts to keep information on our website accurate.
Occasionally, the website may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, availability, promotions or shipping information.
We reserve the right to correct such errors.
If an obvious error affects an order and the contract has not yet been validly completed, we may contact you to correct the issue or cancel the order and provide a refund where appropriate.
We will not use this provision to deprive consumers of rights that have already arisen under applicable law.
19. WEBSITE AVAILABILITY
We do not guarantee that the Services will always be available, uninterrupted or error-free.
Temporary interruptions may occur due to maintenance, technical problems, security incidents or circumstances beyond our reasonable control.
Nothing in these Terms excludes liability that cannot legally be excluded.
20. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Story Shelf SRL shall not be liable for indirect or consequential losses that are not reasonably foreseeable at the time the contract was concluded.
Nothing in these Terms excludes or limits liability for:

death or personal injury caused by our negligence;

fraud or fraudulent misrepresentation;

intentional misconduct;

defective products where liability cannot legally be excluded;

breach of mandatory consumer rights;

statutory guarantees or remedies; or
-
any other liability that cannot legally be excluded or limited.
For consumers, these Terms do not restrict any mandatory rights or remedies available under Romanian or European Union law.
21. FORCE MAJEURE
We are not responsible for failure or delay in performing our obligations where the failure or delay results from circumstances beyond our reasonable control, including natural disasters, war, terrorism, governmental actions, strikes, major transport disruptions, widespread technical failures or other extraordinary events.
Where such an event affects an order, we will take reasonable steps to inform you and fulfil our obligations as soon as reasonably possible.
This section does not remove any statutory rights you may have to cancel an order or obtain a refund.
22. GOVERNING LAW AND CONSUMER RIGHTS
These Terms are governed by the laws of Romania, except where mandatory provisions of the law of the country in which a consumer resides provide otherwise.
If you are a consumer residing in another European Union Member State, you continue to benefit from any mandatory consumer protection provisions that apply to your situation.
Nothing in these Terms prevents you from exercising rights available under applicable EU consumer protection legislation.
For disputes, the competent courts will be determined in accordance with applicable mandatory jurisdiction rules. Consumers may have the right to bring proceedings before the courts of their place of residence where provided by applicable law.
23. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where legally possible.
The remaining provisions will continue in effect.
24. NO WAIVER
If we do not immediately enforce a right or provision under these Terms, this does not constitute a waiver of that right or provision.
25. CHANGES TO THESE TERMS
We may update these Terms from time to time.
The latest version will always be published on this page together with the date of the latest update.
Changes will not retroactively alter contractual rights or obligations that have already arisen, except where permitted or required by applicable law.
